The International Association of Broadcasting (IAB) welcomes the decision of the Constitutional Chamber of the Supreme Court of Justice of Costa Rica to suspend the tender process for broadcasting frequencies (AM, FM and TV) initiated by the Executive Branch.
This precautionary measure, which orders the suspension of the tender proceedings until the Chamber issues a ruling on the constitutional appeal, represents a fundamental step toward preserving the full exercise of freedom of expression and the vitality of the democratic system in Costa Rica.
The IAB reiterates that current broadcasters have a legitimate right to the renewal of their concessions and operating permits, in accordance with the Constitution, the law, international human rights treaties, and the contracts previously executed with the State. Any modification to the rules governing access to or permanence in the radio spectrum must strictly respect these legal frameworks and guarantee legal certainty for the sector.
The decision of the Constitutional Chamber sends a clear message about the importance of ensuring that spectrum management processes are conducted without arbitrariness, without political purposes, and without undermining the editorial independence of the media, thereby safeguarding informational pluralism and the public’s right to be properly informed.
The IAB will continue to support the National Chamber of Radio of Costa Rica (CANARA) and Costa Rican broadcasters in the defense of legality, freedom of expression, and democracy.
