Press Release from the International Association of Broadcasting – Colombia

The International Association of Broadcasting (IAB) expresses its serious concern about statements made by the Colombian Executive Branch regarding the review of the Canal 1 concession and the possible opening of a new bidding process, despite the fact that the current concession is still in force and fully operational.

The IAB recalls that any decision relating to radio and television operating licenses must be made in strict accordance with the Constitution, international treaties, and legislation, while respecting the principles of legal reserve and due process.

Any attempt to restrict or affect the validity of duly granted concessions constitutes a violation of the right to freedom of expression, the duty of non-discrimination, and the right to due process enshrined in the American Convention on Human Rights.

In particular, IAB recalls the provisions of Article 13.3 of the aforementioned Convention: “The right of expression may not be restricted by indirect methods or means, such as the abuse of official controls [...] of radio frequencies [...] or by any other means aimed at preventing the communication and circulation of ideas and opinions.”

Respect for legal certainty, freedom of expression, and due process is an essential condition for democracy.
